Terms of Service

These terms are an agreement between you and Hubertino (“Hubertino”, “we”, “us”), the operator of hubertino.com. By creating an account or using the service you accept them. If you use Hubertino on behalf of a company, you accept them for that company and confirm you are authorised to do so.
1. What Hubertino does
Hubertino extracts information about businesses from publicly available web pages — for example business listings on online maps and the businesses' own websites — and delivers it to you as structured lead lists (dashboard, exports, API). The service is intended for business use, such as market research and business-to-business outreach. You must be at least 18 to use it.
2. Your account
- Provide accurate details and keep your email verified — several features (scraping, purchases) require a verified address.
- You are responsible for what happens under your account and for keeping your password and API keys secret. API keys act as your account for the API — treat them like passwords.
- One person or company per account. We may decline or revoke accounts used to evade limits (for example farming signup credits with disposable addresses).
3. Credits
Usage is measured in credits: 1 credit = 1 result delivered (one business listing for scrapes, one review for review jobs). When you start a job we reserve its worst-case cost (searches × the per-search maximum you chose). When the job finishes you are charged only for what was actually delivered and the rest of the reservation is automatically refunded to your balance. Jobs that fail entirely refund in full. Every movement is visible in your credit ledger.
- Credits included with a monthly plan expire 6 months after they are granted (they roll over until then).
- Credits from one-time packs and the signup bonus do not expire.
- Credits have no cash value, are non-transferable, and can only be spent on the service.
4. Plans, payment and renewal
- Paid plans are monthly subscriptionsbilled through our payment provider, Stripe. Each billing cycle grants the plan's monthly credits.
- Subscriptions renew automatically until cancelled. You can cancel any time in the billing portal; the plan then runs to the end of the paid period and is not renewed.
- Upgrades take effect immediately: Stripe charges a prorated difference and the credit difference is added to your balance.
- One-time credit packs are charged once at purchase.
- Displayed prices exclude VAT and similar taxes, which are calculated at checkout based on your billing details. Business customers can enter a VAT ID at checkout.
- If a renewal payment fails, Stripe retries it; if it keeps failing the subscription is cancelled and your account falls back to the free plan. Credits already granted keep their normal expiry.
5. Refunds
Unused parts of a job's reservation refund to your credit balance automatically, as described above. Money payments are final except where the law says otherwise. If you are an EU consumer: by purchasing you request immediate performance, and you acknowledge that your right of withdrawal ends once the service has been fully performed — for credits, once they have been spent. If you bought a plan or pack and have used none of it, contact us within 14 days and we will refund it.
6. Acceptable use — this part matters
Hubertino gives you data about businesses gathered from public sources. Once you export it, you are the controller of that data and responsible for how you use it. You agree to:
- comply with all laws that apply to your use of the data — including data-protection law (such as the GDPR), anti-spam and e-marketing rules (such as the ePrivacy rules, CAN-SPAM, CASL) and telemarketing rules in the countries you contact people in;
- honour opt-outs and objections from the people and businesses you contact;
- not use the data or the service to harass, threaten, discriminate, deceive, or send bulk unsolicited messages in breach of applicable law;
- not resell, republish, or make the raw output available as a standalone dataset, database, or competing data product;
- not probe, overload, or circumvent the service's technical or usage limits, share accounts to evade plan limits, or use the service to build a competing scraper;
- not use the service against sources you have no lawful basis to collect from, and not target private individuals — the service is built for information about businesses.
We may throttle, suspend, or terminate accounts that violate this section. Serious or repeated violations forfeit remaining credits.
7. The data and its sources
The information Hubertino delivers is collected from third-party public sources at the moment your job runs. Those sources change constantly and are outside our control. The data is therefore provided “as is”: we do not warrant that it is accurate, complete, current, or fit for a particular purpose, and you should verify it before relying on it. Coverage, fields, and speed can change as the sources change.
8. Availability
We aim to keep Hubertino fast and available but do not promise uninterrupted service, and offer no SLA on the free or standard paid plans. We may queue or rate-limit jobs to keep the platform healthy, and may modify or discontinue features. For material changes that affect paid features we will give reasonable notice by email or in the app.
9. Intellectual property
The Hubertino software, site, and brand are ours. Your scrape definitions and settings are yours, and you may use your exported results freely within these terms. If you send us feedback or suggestions we may use them without obligation.
10. Third-party services
Payments are processed by Stripe and transactional email is delivered through our email provider; their processing of your data is described in our Privacy Policy. Third-party sites the data links to (business websites, social profiles) are not ours — their terms apply to them.
11. Privacy
How we handle personal data — yours and the business data the service processes — is described in the Privacy Policy. IP complaints are handled per the DMCA / IP policy.
12. Termination
You can stop using Hubertino at any time; cancel subscriptions in the billing portal, and contact us to close your account entirely. We may suspend or terminate accounts that breach these terms, create risk for the service or other users, or where we must by law. If we terminate your account without cause, we will refund the unused paid portion of the current billing period.
13. Disclaimers and liability
The service is provided “as is” and “as available”. To the fullest extent allowed by law, we exclude implied warranties and we are not liable for indirect or consequential damages — lost profits, lost data, lost business — arising from the service or the data it delivers. Our total liability for all claims in any 12-month period is limited to the amounts you paid us in that period. Nothing in these terms excludes liability that cannot legally be excluded (for example for intent or gross negligence), and if you are a consumer your mandatory statutory rights are unaffected.
14. Indemnity
If a third party brings a claim against us because of how you used the service or the data you exported — including claims from people you contacted — you will defend and indemnify us against that claim and its reasonable costs.
15. Changes to these terms
We may update these terms as the service evolves. For material changes we will notify you by email or in the app at least 14 days before they take effect; continued use after that is acceptance. The current version always lives at hubertino.com/terms.
16. Governing law
These terms are governed by the laws of the European Union member state in which Hubertino is established, and disputes belong to the courts of that state — except that consumers keep the protection of the mandatory rules, and the choice of courts, of their own country of residence.
